(Chicago, Illinois) – Lawyers for the aggrieved former “Empire” actor Juicy Smollett have filed an urgent motion to suspend his sentence and release him on bond for just a few days of his five-month sentence.
The actor’s attorneys filed an emergency injunction on Friday seeking Smollett’s release pending his appeal. His lawyer argued that Smollett was in danger and was the target of an online threat of bodily harm.
So following the lawyer’s argument, jail will be the safest place for him. His attorneys say Smollett’s family has been receiving threatening phone calls since the jail number was listed as an emergency contact for his release.
Defense is also arguing against keeping Smollett in a separate prison, which the jail will do for his safety, as it could potentially harm his mental and physical health.
So the lawyers’ argument is that the judge should release Smollett. Very convenient but it will not work. In some cases the annoyed judge will not give him leave for good behavior and will force him to work for full 5 months.
“Mr. Smollett has become the target of horrific threats on social media forums that undoubtedly reflect the hatred and desire for bodily harm that he may feel during his imprisonment,” Smollett’s filing said.
“Mr. Smollett speculates that he may be placed in solitary confinement or in protective custody, both of which are ridiculous for solitary confinement; a situation that could cause significant harm to his mental health,” the filing continued.
“As a result, any custody setting poses a safety and health hazard to Mr Smollett’s life,” the filing said.
Jussie Smollett’s sister, Jurnee Smollett, said Cook County Jussie should be released because of the difference in prison rates between black and white Americans in state prisons. Journey Smollett says:
“Black Americans are about five times more likely to be incarcerated in state prisons than white Americans. Juicy is innocent. And you don’t have to believe in his innocence to believe he should be free. “
Smollett’s brother says:
“So Juicy is currently in a psychiatric ward at Cook County Jail. It is a matter of great concern that a note was attached to his papers today and placed in front of his jail cell stating that he was at risk of suicide, “said his brother Jockey Smollett.
“I want to make it clear to people that he is not at risk of self-harm in any way, shape or form. He wants to let people know that he is very stable, that he is very strong, that he is very healthy and that he is ready to accept the challenge that has been taken against him.
“It’s not right. It’s a complete lack of justice. It’s angry. It’s annoying, but in the end he knows what to do.”
“So please, make sure you spread all the information. We really need our people to support us, “said Jockey Smollett.
Judge Lynn said in sentencing:
“You are not a victim of racial hatred, you are not a victim of homosexuality.
“You’re just a charlatan pretending to be the victim of a hate crime, and it’s a shame,” the judge said.
The Cook County Sheriff’s Office said:
“Mr Smollett is being held in his own cell, which is monitored by security cameras in the cell and monitored by an officer wearing a worn-out camera, who is at the entrance to the cell to make sure Mr Smollett is always under direct surveillance.”
“Like all detainees, Mr Smollett is entitled to ample time in the general area outside his home where he is being held, where he is able to use the telephone, watch television and communicate with staff.
“Outside the cell at such times, other prisoners will not be present in the general area.
“These protocols are routinely used for persons in protective custody who may be at risk of harm due to the nature of their charge, their occupation or their significant condition.
“The safety and security of all detainees, including Mr. Smollett, is the Sheriff’s Office’s highest priority,” the office said.
