During part of the first day of the congressional hearing on the nomination of Supreme Court Judge Ketanji Brown Jackson, MSNBC’s 11th hour Host Stephanie Ruhel was apparently disappointed that Senator Josh Howley asked Jackson about his history of being convicted of viewing or distributing child pornography.
Ruhel began by airing a soundbite broadcast by Fox News contributor Andy McCarthy, criticizing Howley for highlighting Jackson’s record. He then mourns that incident “Josh Howley is not behind” And “What he’s doing is dangerous, it’s killing a woman’s character that’s going to be confirmed.” He then asked his guest Melissa Murray, a professor at NYU Law School, to “accept what he was doing”?
Murray replied “My view on this is that it’s not really about Ketanji Brown Jackson. He, as you say, is a predetermined conclusion, an unpleasant conclusion. He will sit in the Supreme Court, and Josh Howley knows that.” He then assumed that Hawley was using the confirmation hearing only for political gain. “What is it, about 2022, and the midterm elections, and 2024. I think we’ve seen all Republicans read this line.” Dr. Murray.
Murray continues to propagate his theory that this is Howley’s big political game:
They are simply creating a soundbite that is set to be used in the mid-2022 and again 2024 presidential elections, essentially to make the argument that the Republican Party is tough on crime. It’s tough against crime. And Democrats are soft on crime. He is merely a pan in a political activity, which will be published in the next few months and indeed, for the next few years.
Ruhel then asked Murray about Jackson’s qualifications compared to the judges appointed by former President Trump. “[Trump] Approximately a dozen judges nominated, rated by the American Bar Association not qualified. Now, according to the same American Bar Association, Judge Ketanji Jackson has the highest possible rating. ”
Murray then gush about how to proceed “Absolutely the best” Jackson and how Republicans can’t oppose him on merit. He claims that he is “What a nominee for this role has to say to explain their objections, who have absolutely the highest credentials and qualifications, he’s really ready for the moment. I think they know that. And the objections that we’re going to hear in the last few days, I think. Really made. ”
Murray ends his disguised remarks without evidence of Republican objections to Jackson’s nomination. “It’s not about him, it’s about this larger, more political struggle, and I think the less we play into his description, the better.”

Melissa Murray: My point about this is that it’s not really about Ketanji Brown Jackson. He is, as you say, an incredible fulfillment of a predetermined conclusion. He will sit in the Supreme Court, and Josh Howley knows that. What it is, about 2022, and the midterm elections, and 2024. I think we’ve all seen Republicans fall into this line. Specifically claiming that she is a woman who is soft on crime, that Democrats are soft on crime, that the Biden administration is soft on crime, and that they are laying the groundwork for dialogue, which is not easily denied. His record and lawsuits and what is going on at the granular level in these areas. They are simply creating a soundbite that is set to be used in the mid-2022 and again 2024 presidential elections, essentially to make the argument that the Republican Party is tough on crime. It’s tough against crime. And Democrats are soft on crime. He is merely a pan in a political activity, which will be published in the next few months and indeed, for the next few years.
Ruhul: All right. The former president, now a resident of Florida, has nominated roughly a dozen judges that the American Bar Association has rated unfit. Now, according to the same American Bar Association, Judge Ketanji Jackson has the highest possible rating. So, help me understand, what measure could Republicans probably use, that they are perfectly happy with Trump’s employers, but not with this Biden pick?
Murray: Well, I don’t know what to say to a nominee for this role, who has absolutely superior credentials and qualifications to explain their objections. He really made one for the moment. I think they know it. And the objections that we are going to hear in the last few days, I think will really make. They will be thinner but are designed, again, to be less about this confirmation. Which, again, is a predetermined conclusion, and much more about laying the groundwork for a political battle that has yet to come. He is just an opportunity to make these arguments about the Democrats being lenient towards crime, creating the constitutional rights of Democrats and being lenient towards the Constitution. It’s not about him, it’s about this larger, more political struggle, and I think the less we play into their description, the better. Because, it’s not about her, it’s never about her. Because he’s absolutely awesome.
